TERMS AND CONDITIONS OF SALE – ENOTECA LEOPOLDO
1. Company Information and Scope
This website and the related sales services are operated by Enoteca Leopoldo (“Enoteca Leopoldo”, “we”, “us”, “our”).
Any user accessing the website or placing an order is referred to as the “Customer”.
By accessing the website and/or purchasing products, the Customer fully accepts these Terms and Conditions of Sale, which govern the offer and sale of wine and related products in Italy and internationally.
2. Sale of Alcoholic Beverages – Legal Drinking Age
The sale of alcoholic beverages is strictly reserved to Customers who are at least 18 years old.
By placing an order, the Customer declares and guarantees that:

they are of legal drinking age under Italian law and the laws of their country of residence;

all information provided during the purchase process is truthful and accurate.
Enoteca Leopoldo reserves the right to request age verification (including identification documents) from the Customer or recipient and may refuse delivery if age compliance cannot be confirmed.
3. Order Process and Confirmation
Orders may be placed:

through the website;
-
via WhatsApp, with direct assistance;
-
through customized shopping carts created by Enoteca Leopoldo and sent to the Customer.
Some products, including limited vintages and pre-orders, are available in limited quantities.
The vintage is clearly communicated and confirmed at the time of purchase, and the shipment will always correspond to the agreed vintage.
Enoteca Leopoldo reserves the right to refuse or cancel orders that appear irregular, incomplete, or suspicious.
4. Prices, Payments and Contract Conclusion
All prices are expressed in Euros and may change without prior notice.
Shipping costs, taxes, customs duties and any additional charges are not included in product prices and are calculated before order confirmation.
Payments are processed through secure and authorized payment methods.
The sales contract is considered concluded only upon receipt of payment by Enoteca Leopoldo and the issuance of an order confirmation.
5. Shipping
5.1 Logistics Partner
All shipments are handled by Mail Boxes Etc. (MBE), a logistics provider specialized in wine transportation using certified protective packaging.
5.2 Shipping Schedule and Delivery Times
Orders are dispatched on the first available Tuesday or Friday following payment confirmation.
Estimated delivery times vary depending on destination:

Italy: 2–6 business days

European Union: 7–15 business days
-
Extra-EU countries: 10–20 business days or more, depending on customs procedures
Delivery times are indicative and not guaranteed.
5.3 Insured Shipping
Customers may request insured shipping for an additional 2% surcharge.
Insurance covers visible physical damage at delivery only and does not cover:
-
heat or cold damage;
-
thermal shock;
-
changes in taste, aroma, or quality;
-
cork defects;
-
bottles that have been opened or tampered with.
5.4 International Shipments and Customs
For international shipments:
-
customs duties, taxes, import fees and any additional charges are the sole responsibility of the Customer;
-
the Customer is responsible for verifying local regulations regarding alcohol imports;
-
any shipment refused, blocked or seized by customs remains the Customer’s responsibility, including related costs.
6. Delivery, Risk Transfer and Claims
Wine is a product sensitive to environmental conditions. The Customer acknowledges and accepts the risks associated with transportation, especially during periods of extreme heat or cold.
In the event of visible damage upon delivery, the Customer must:
-
sign the delivery with reservation;
-
immediately take clear photographs of the package, packaging and bottles;
-
send the documentation to Enoteca Leopoldo within 24 hours of delivery;
-
retain the original packaging and contents.
Without a signed reservation and proper documentation, no claim can be filed with the carrier or insurance provider.
Enoteca Leopoldo will handle the claim process with the carrier where possible. In cases where formal claims are not admissible, only a goodwill solution may be evaluated, without any admission of liability.
In accordance with applicable law, the risk of loss or damage passes to the Customer at the time the goods are handed over to the carrier, without prejudice to mandatory consumer protection rights.
7. Right of Withdrawal and Returns
Pursuant to Article 59 of the Italian Consumer Code (Legislative Decree 206/2005) and Directive 2011/83/EU, the right of withdrawal does not apply to:
-
goods liable to deteriorate rapidly, including wine;
-
sealed goods that are not suitable for return for hygiene or safety reasons;
-
goods customized or selected upon the Customer’s request, including pre-orders and specific vintages.
Accordingly, returns and refunds are not accepted, except in cases of:
-
delivery of an incorrect product;
-
proven non-conformity attributable to Enoteca Leopoldo.
No refunds are granted for personal taste preferences, cork defects, heat damage, or improper storage after delivery.
8. Product Availability and Vintages
Product availability is subject to confirmation at the time of order.
The shipped bottles will always correspond to the vintage confirmed at purchase.
In the rare event of sudden unavailability, the Customer may choose between:

a full refund; or
-
a mutually agreed replacement.
9. Limitation of Liability
Enoteca Leopoldo shall not be held liable for:
-
delays caused by carriers, customs authorities, holidays, or force majeure;
-
deterioration due to temperature exposure or improper storage after delivery;
-
variations in taste, aroma, or organoleptic characteristics;
-
customs restrictions, seizures, or import prohibitions imposed by destination countries.
Any liability, where applicable, is strictly limited to the purchase price of the product.
10. Personal Use and Resale
Products are sold exclusively for personal consumption.
Resale or commercial redistribution without prior written authorization from Enoteca Leopoldo is prohibited.
11. Intellectual Property
All content, including texts, images and product descriptions, is the exclusive property of Enoteca Leopoldo.
Unauthorized reproduction or use is prohibited.
12. Governing Law and Jurisdiction
These Terms and Conditions are governed by Italian law.
For EU consumer Customers, jurisdiction lies with the courts of the Customer’s place of residence.
For professional Customers, exclusive jurisdiction lies with the Court of Siena, Italy.
13. Communications and Contacts
Official communications may be sent via email or WhatsApp, as used during the ordering process, and are deemed valid for contractual purposes.

14. Amendments to the Terms
